Terms and Conditions of Use

1. General Information

Teckoff (hereinafter referred to as 'the Company') is a company registered with the Pontoise Trade and Companies Register under number 937 998 581 R.C.S. Pontoise, with its headquarters located at 7 Rue Vauconsant, 95110 Sannois, France. The Company offers an online platform for creating LinkedIn content using artificial intelligence (AI), along with scheduling and publishing tools. 2. Description of the Service

The Teckoff platform enables users to create LinkedIn content, either manually or by using an AI-based content generator with various sources of inspiration (subject ideas, articles, videos). The platform also allows users to schedule and publish their content directly on LinkedIn.

3. Access and Registration to the Service

The Teckoff service is accessible 24/7, subject to maintenance periods or technical interruptions beyond the Company's control. Users can register by creating an account via their email address or by using LinkedIn SSO. Each user is granted a one-month free trial to test the service. Once the trial period expires, a paid subscription is required to continue using Teckoff.

4. Use of Service and Prohibited Conduct

Users are solely responsible for the content they publish or schedule via the Teckoff platform. The following behaviors are strictly prohibited: spamming or sending unsolicited content, abuse of the service including platform overloading through excessive requests, and posting illegal or inappropriate content (promoting violence, racism, or any form of discrimination). In case of non-compliance, the Company reserves the right to suspend or terminate the user’s access without prior notice.

5. Payment Terms

Financial transactions related to paid subscriptions are managed by LemonSqueezy, a third-party provider specializing in payment processing. By subscribing to a paid plan, the user also agrees to LemonSqueezy's terms of service and privacy policy. The Company is not responsible for any errors or incidents occurring during the payment process managed by LemonSqueezy. Subscription prices are as follows: €0/month for the Free Plan and €10/month for the Advanced Plan.

6. Limitation of Liability

Teckoff uses AI technology to generate content for inspiration purposes. However, the Company does not guarantee the accuracy or quality of the generated content. Users are solely responsible for the content they publish or generate via the platform. The Company disclaims all liability for indirect damages, such as loss of revenue or reputation, caused by user-generated content.

7. Force Majeure

The Company shall not be liable for any delay or failure in performing its obligations due to events beyond its control, including but not limited to natural disasters, armed conflicts, strikes, pandemics, infrastructure failures, or public service interruptions. Such events constitute cases of force majeure, exempting the Company from its obligations during the period of the event.

8. Protection of Personal Data

Teckoff collects personal data such as email addresses and LinkedIn account information to create and manage user accounts. The processing of personal data is based on the user's consent or the necessity to execute a contract. Data is retained indefinitely unless the user requests modification or deletion. 9. Intellectual Property and Exclusive Rights

The exclusive usage and exploitation rights of the Company include: copyright, trademarks, designs, models, and other intellectual property rights relating to products and their visual representations; all logos, distinctive signs, and the appearance of elements associated with the Company’s products. These intellectual property rights apply worldwide. Users are strictly prohibited from discrediting or devaluing the Company's trademarks, trade names, distinctive signs, products, or services; or unfairly benefiting from the reputation or notoriety attached to the Company's trademarks or other distinctive signs to promote unrelated products or services. The Company's products are provided under a limited right of use; no transfer of ownership is made. This usage authorization is limited to the territory of France. Without prejudice to the foregoing, the user acknowledges and agrees that they hold no ownership rights over the content or deliverables generated through the platform beyond the strictly granted usage rights.

10. Subscription and Termination

Users may cancel their subscription at any time through their user account. Cancellation takes effect at the end of the current subscription period, and no refunds are issued for already invoiced periods. The Company reserves the right to terminate or suspend an account in case of non-compliance with these Terms and Conditions.

11. Changes to the Terms and Conditions

Teckoff may amend these Terms and Conditions at any time to address legal, technical, or business developments. Users will be notified of any modifications through notifications on the platform.

12. Independence of Clauses

If one or more provisions of these Terms and Conditions are found invalid or unenforceable by a competent jurisdiction, the remaining provisions shall remain in effect and retain their full enforceability.

13. Entire Agreement

These Terms and Conditions constitute the entire agreement between the user and the Company regarding the use of the Teckoff service, replacing any prior oral or written agreement or communication relating to this subject.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the country where Teckoff is registered. In case of disputes regarding the interpretation or application of these Terms and Conditions, and if an amicable solution cannot be found, the competent courts shall be those of the jurisdiction where the Company's registered office is located.
